Do You Qualify for Unemployment?

You can get unemployment if you can answer "Yes" to all three of these questions:

EXPLANATION: The amount of benefits you get depends on how much money you made in the 12 months before losing your job. This is called your base period.

EXPLANATION: If you were laid off, fired, or left the company for a good reason (like an illness), you could qualify. You will not qualify if you quit your job.

EXPLANATION: You must be ready, willing, and able to work. You can’t be too sick, injured, or disabled to work.

I was givent he option from my employer to walk out or be terminated. I chose his termination, now he is telling work force I walked out how can I win the appeal?

I moved to Iowa in July, 2009. I quit my 12 yr. job in NJ to move to IA. I was not "street smart" & didn't know what I was supposed to do for unemployment. I have never NOT had a job since I was 18 yrs. old. I was denied unemployment benefits because I voluntarily quit my job in NJ to move here. Now, I have been out of work since July, still having a hard time actually finding a job (I can't believe it). The only way I am surviving right now is because I was forced to cash in my 401k so I could pay rent, eat, pay bills, etc. I have lived here in IA for 9 months now. I'm a military spouse who was employed with the same company for 3 years. When my husband had orders to relocate from San Diego, CA to Cameron Park, CA last August I gave my employer more than 2 weeks notice that I'd be relocating at the end of October. Once situated in Cameron Park and available for employment, I applied for unemployment on 12/27/09 and began receiving monies about a month after. On 2/18/10 I received a Notice of Appeal and Transmittal of Appealed Determination from EDD to be expecting a notice for an appeal hearing because my former employer has appealed EDD's decision. I recently had a baby and went on "leave" since I didn't qualify for any maternity or disability leave (FMLA) in September. My employers knew that I didn't have a babysitter until January 2010. As soon as the first Monday of the year, I was able to get a sitter and started to call in available for work. I called my company every week and after three weeks filled for unemployment benefits since they were telling me that they were "working" on getting me back. As of today, my employer let me know that I would have to be "rehired" again, so I need to fill out new paperwork and everything. If they decide to lower my wages, do I have to accept their new offer? I am currently in Georgia and couldn't find any information regarding pay decreases. My wages are already pretty low under $30k a year but if they offer me less, I can't make ends meet. I have to drive 36 miles one way to work. So that's about two tanks of gas a week at $30 each. I also have a babysitter for $100-$150/week for my son. At my previous wage that would leave me about $250 a week to pay for housing, bills, credit card and food. Can I refuse the lowered wage and still qualify for unemployment benefits? My previous pay was $14/hr, do I have to accept a job that offers lower than that? Thank you for any help!

I have been a 1099 employee of a fortune 100 company consistently for five years. I was an employee of that fortune 100 company for seven years prior. This company paid me through a third party agency, who issued me the 1099s. The Fortune 100 company provided me with my equipment, dictated the hours I worked, reimbursed me for travel expenses to attend meetings, required weekly hourly status reports and provided me an e-mail address at the company. I paid my own social security taxes etc.. Do I qualify for unemployment insurance??

I gave 4 weeks notice that I was going to quit my job and move from Ohio to another state to look for a job near friends. I was fired on the spot. I do not have another job and was counting on the one month of pay to help me move. I wanted to help my employer by giving them plenty of time to prepare. Now I am hurting. 2 weeks ago I put in my notice to leave as of March 11,2010. Today I was informed they were accepting my resignation and it would be my last day. The reason I put in my notice is that my wife found a job in Arizona, we live in Wisconsin, and she took it so I am relocating because of that. I've been working for my employer since november '07 and mid june 2009, i took intermittent FMLA to care for my fully disabled mother who had a brain aneurysm and stroke. I took intermittent FMLA so i could still work and support us. However, in November, my blood pressure was extremely high and I got dizzy at work. My HR director advised me to take the remaining FMLA for myself and my mother in a 2 month block- thus killing 2 birds with one stone. I have since been released to work again by my doctor jan 7th '10 (who documented that I was under extreme caregivers stress due to the situation with the job and mom).

Since returning to work, I have had more stress with going back and forth because my mothers house is 1.5 hour away from my job and her SS claim has not allowed for a home health care aide to come and assist just yet- taking me BACK to square 1 where I need to either take off periodically to care for her OR find something closer and different hours so I can support us in the meantime.

I applied for leave through my employer, which they stated would not protect my job and may or may not get approved, which it didn't. So if they fire me for absences due to the care of my sick mother, can I get unemployment? If they don't fire me, can I quit and get unemployment while I look for something closer with different hours? I don't want a huge gap where there is no income. Waiting for her benefits would be stressful.

I just lost my job. I am trying to figure out if I would qualify. This is what I don't understand/ Indiana states " You must have earned total base period wages that are 1.5 times greater than your highest quarter" in their handbook. If that is true, I won't qualify. because my last quarter I received more hours and made more money. However I have only been employed for a total of 3 quarters. I was self employed before that previous employment will not be counted. So I started employment in April of 2009 Here are the wages:
My wages for May-June 2009 were $2303, July through Sept $ 3274 , and October through December $ 4563. The way I am figuring this out is that my last quarter wages of $4563 were too high for me to qualify.
Current Base period is (April-Sept) $ 5577.00 (Oct-Dec) $4563 x 1 1/2% = $ 6844.50 So because I do not have a base period of 4 quarters this is hurting me, because my Oct-Dec quarter is more than my base quarter and I may not qualify?

So I guess my real questions are....am I figuring this out correctly? and if I am are things figured out differently for people who have not been on the job that long?

I worked in a small family size business for many yrs. and had all taxes taken from my check. About a year ago, I had to quit the job because my husband and I bought a house more than 80 miles away (each way). I gave 2 months notice. My husband was able to continue with the job he had previously but it was too far for me to drive each day. We moved because this was a better area to raise our children (aged 11yrs and 15 yrs).
Would I qualify for unemployment? It has been almost a year since I quit. I really would have liked to continued but it was just too far and the cost of gas would not make it worthwhile.

All right I am supposed to be starting a CDL course on 2-22-10 I have a meeting on 2-1-10 with unemployment, buy my brother in law works at the same company that I used to work for, he calls me and tells me that they might be calling me this week. I would like to know if I get approved for funding from NYS unemployment on monday today is saturday, am I obligated to go back to work or would I be able to tell them that I am going to school? I know that I can't deny a job or my benefits could be cancelled. So any answers would help out. thanks in advance?!?!?!!

Clipse, you need to contact the NYS Unemployment office. I suspect that you would be putting your benefits in jeopardy by turning down work but only NYS Unemployment can tell you for sure. If you are looking for money to live on whole going to school, you should look into financial aid and student loans. I recommend that you take a look at our Paying for College section.

I was recently offered to resign from my position of 4 1/2 years with my company or be terminated on the spot. I was told it was due to material found on my company-provided laptop and given no other explanation or evidence. I chose the resignation. How do I answer the fired/laid-off question, as I did not want to leave my position and would I qualify?

Mike, answer that you did not leave your job willingly. If they ask for further explanation, explain it to them just as you have explained it to us. Your former employer should be able to verify your version of the circumstances.

I was laid off as a mortgage loan officer/processor back in Aug 09. My boss keeps calling me asking me business questions, because he doesn't know my job. I have helped him out but it started to get a little old. I made the comment that it sounds like he needed to put me back on payroll. I was receiving a base salary of 25k and then I would receive approx 25K in commission. He said that he can not afford to put me back on payroll, but is willing to let me work from home for commission only. The commission formula would be even less that what I was receiving before. I would have to work about 5 hrs/week for a month or two, then once the file was closed/sold I would then receive the commission. I understand that I would not receive my unemployment for the week I was pd and that I would have to go in and refile/restart my claim. But could this kick me out of the system totally ? This is not the best situation, I would rather go work for another company FT, but it is something for now. I am in GA.

Rey, there is no way to answer this question accurately unless you file for unemployment benefits in your state. Put in an application and they will make the determination.

I have been employed at my current job for almost five years. I am in school and am doing a good job not allowing it to interfere with my work. My employer has made it clear that they will not cater to anyone's school schedule and eventually I will have to take classes that will interfere and may have to quit. I have been looking high and low for another job anywhere but with no success thus far. I am planning on approaching my employer hoping they will work with me. nfleishell13, You could put your benefits in jeopardy by turning down work. You should contact your state's unemployment agency and speak to them about your questions and concerns. If they will not allow you to collect unemployment because you lost the job do to your own actions, you should look into financial aid and student loans. Many people are understandably wary of taking out student loans but if you need them to pay your bills while you are putting yourself through school this will lead to a higher paying job which will allow you to pay back the loans and have a better life. In the long run, it's probably the right decision.

I have worked for a company in Tn for almost two years. I received a two week notice as of 12/27/09 due to lack of work. Upon recieving that notice she offered me to become a 1099 status employee, but could not guarantee me any work. If I decline this offer am I still eligible for unemployment benefits in the state of Tn.

CowboyDave10, you need to contact your local unemployment office, they are the only ones that can answer this question accurately. Even if you do become a 1099 contract employee, you still may be able to qualify for partial unemployment when there is no work, but again, this is something that you need to ask your local unemployment office.

derek, you might qualify, but there are a lot of circumstances involved. Your best bet is to simply fill out the application and let your state make the final determination.

Odd situation here, I worked from 10/2008 - 4/2009 (6 months) with a company that went out of business. I filed and got unemplyment, but because I only worked 6 months, the state of MA only gave me about 13 weeks of unemployment, and that is not the full amount. All was fair, I got another job about a month after unemployment ran out. I have been working that job now for about 5 months. The manager is now discussing layoffs and they are a real possibility for us contract workers. Would I be able to get unemployment, even though I applied and got 13 weeks and only have 5 months of work before I applied again? (I read that they needed a 12 months base period, but what if I have not been working for 12 months? I did earn unemployment previously as I stated.) Thank you!

I am currently recieving unemployment benefits (initial 26 week claim) and I am concerned because my unemployment benefits will soon run out. I need to know about the expanded emergency unemployment compensation program. Will I be contacted about how to extend my benefits before they run out or will I have to file a new claim? I can answer one of your questions. I just exhausted my benefits when I filed my last webcert, I was only paid for one week but filed for two. The 1st week was my 26th week, so apparently there is a lapse in benefits (nice timing with Christmas, isn't it?). My understanding is that after our benefits are exhausted they will send out a letter telling us how to file for the EUC benefits and that we cannot do the first claim online, it has to be via telephone. I have been calling for the last two days and the few times I actually got into the automated system and pressed the options to get to filing my first EUC claim, I am told all customers services representative are busy call back later. I just want to know when I will get my letter and how long I have to wait before my benefits resume. I know Congress screwed up when they gave the last 13 weeks, they failed to extend the program past 12/31/09 (just a clerical or minor error they say). But I'm thinking since I ran out before then I might be fine, they are planning to fix the error but it might not be until after the holiday break. Anyway, that is what I know now, as soon as I know more I will post again and let me know if you find anything out. Thanks.

If I got paid $6.55 an hour at a part time job (with little benefits) will I be able to apply for unemployment benefits? How much would it be? $54.00 a week? It was rare that I made that much with the amount of time they needed me and I need something that I can live off of until I can find work. I've been avidly job searching and still nothing. Thanks!

GarmRO, as long as you didn't quit your job, you have a good chance of qualifying for unemployment benefits. Usually the benefit rate is about half of what you made per week but it's different in every state. You should apply for benefits and let your state make the determination.

I have been working a job with varying hours since May of 2005 - then in Sept 2007 I accepted a second job - I worked both jobs unitl January of 2009 when the second job I obtained in Sept 2007 ceased to schedule me due to the poor economy - they told us not to apply for unemployment because we would be recalled (they also owe me paychecks) in October 2009 - it is now December 2009 and I have not been recalled - and I found out they have hired new employees. I have continued to work the job I have had since May of 2005 - but hours are currently being reduced to a low level and rumors are it will go out of business. Last April I applied for Snap (food stamp benefits and was accepted on that program). Can I apply for unemployment benefits for the second job which didn't recall me - or is it too late to do so? Or should I wait and see if I am laid off from or the first job site goes out of business? I am barely able to make my bills. I am registered for work and actively seeking employment - this is required to get Snap benefits. I live in Indiana. Thank you.

Sandy, you should go ahead and apply for benefits. You may be able to receive partial unemployment. It will depend on a number of circumstances and the state of Indiana will be able to make a final determination. Make sure that you fill out the application accurately and honestly and contact your local office with any questions you may have about your specific case.

Hi, I have been working for family dollar for the past nine years and on 10-26-09 I was fired for not protecting company assets. A store manager is graded on the yearly inventory which I was know in the company for running low shrink stores. Every store that I have worked at the inventory shrink has gone down in great numbers. The last inventory in March 09 I took a 90k shrink down to 35k . Now seven months later you tell me I am fired for not protecting company assest. My whole distrist had a manager's meeting no more than three months before I was fired and I was awared Top in the disrict for saving the most payroll to sales. To talk on sales I was in the top 10 in my district every week. I was able to beat last years sales and the plan. I was making money for the company which I. Worked hard for 60 to 70 hours a week and getting paid for 52 hours. I never took anything out the store without paying for it or allowed anyone to walk out the store without paying for it. The inventory for the store was in March 2010 and I was fired off people guessing my inventory levels and not the actual amounts. If I was running a high inventory loss the normal case was for the company to sent the Reginoal Loss Prevention Manager which never came to the store or interviewed me. Also my normal Regional Store Aduiter was sent to a new distrist and the new one scored me five day before I was fired and scored me a 81 out of 100. That was the lowest score I had in nine years. I had abad feeling about that since I was off the day before that and it was my truck day which my boss was aware. Just before the Store Aduiter started my boss and him walked to the stockroom and talk for 30 mintures. I was unable to correct any problems in the store from the day before due to my truck came in one hour after I open the store. I have worked hard and been loyal to this company for years to be told bye and to put my years of service to shame by giving me a false reason for been fired. I have no problem with the company, but my boss was wrong. He also fired every member of my staff for the same reason. This store and most of the Family Dollar stores are not in the best areas without any police or guards. That is the job for the store manager. Funny everytime I called the local police to help for shopplifters they would say where are the guards. Now I have been without a job for one month and I have to fight for a appeal with Georgia Dept. Larbor to pay my past due bills and take care of my family. I am lost and I need help not a hand out, I will work. Thank anyone in advance who can help me

i worked for a national company in maryland (verizon).. they recently renewed their contracts and everyone that started after 2003 in specific groups had to be surplused.. if they could not be placed for another job in the company or simply accept a severance package, they would be laid off. I did not take the package and i applied, tested, interviewed for multiple jobs within the area.. the first job i tested for i failed so i didnt qualify, the 2nd i tested, passed, and interviewed for but the job went to someone with more senority than me.. i wasnt notified of this until the day before my last day on payroll. So on my last day there were no more jobs available to take in MD but there was some in west virginia, and there was no way of me to relocate to another state (hardship) so i was ultimately laid off..

i applied for unemployment and now im being told after abt a month after getting laid off that my company is saying i voluntarily quit, which isnt true.. but because i didnt apply for a job in west virginia that means i rejected work from them.. which is crazy b/c theres no way to pick my life up and move to another state for a job i wasnt even guaranteed to get.. i have a life and responsibilities in maryland.. and they never even spoke abt accomodating me with the funds to relocate or anything.. so i feel like this isnt fair to me to be denied.. i didnt voluntarily quit... i stayed until the last day trying to apply for jobs with them, but another state is not realistic for me. What can i do?

You may also want to speak with an attorney. Hi I used to work full time for a large corporation in Boston, MA while living in Providence, RI. This company was paying me about 500 a week after taxes. Before starting this job I had an unusual injury in my wrist, which got much worse while working at this company, and I was not able to do the work. For this reason I quit this job and I took another job which was less intensive on my wrist. This positionwas commission based (with potential for a salary 6 months down the road). The thing about this second job was that I was actually going to be filing my taxes as self employment income in the first 6 months if I earned anything. Unfortunately 1.5 months into the job the owner closed the office unexpectedly and stole thousands of dollars from me and some other people. What I would like to know is whether I have any chance to collect for unemployment while I look for another job. I realize I have an unusual case because I willing left my salaried job for another commission based job, only to find out that the second job was a scam. I can't go back to the original job and I haven't been able to find another similar paying job. Sorry I think I accidentally posted this in another category.

My husband just got notice last week that his company is changing offices and the new location will be significantly further away. He has until the end of this week to let them know if he will be moving with them or not. He is also on FMLA for care of a disabled spouse as I am disabled and on occassion need his help. This sometimes means he goes to work and I have to call him to come home early for help and being so much further away would make it extremely difficult. He is willing and able to work as it is not his own disability. Would he qualify for unemployment if he said he was leaving the company due to the location change and the hardship it would place on his ability to help me when needed?

I worked for Harrah's Entertainment for 35 years in Payroll starting as a clerk and advancing to supervisor. I was laid off in October 2008 for elimination of position. I was given a six month severance package. I actively seeked employment. In November 2008, I found employment as a Property Manager with the non-profit company Global Property. In February 2009, I had to resigned to care for my aging parents while my sibling, their main caregiver, had surgery. I secured employment in April 2009 with Ameristar Casino, Inc. at the Corporate level. In addition to processing the regular biweekly payroll which was my main duty at Harrah's, the position at Ameristar required a high volume of working with Excel Spreadsheets; closing payroll to the general ledger and payables; garnishments; leave of absence accrual corrections (which I needed to know but would be shown to me at a later date); out-of-state taxes, etc. All this had to be done weekly because at the end of August, I was given a second property to pay. I was not fast enough to meet the deadline (there was a time difference because the Payrolls that I processed were in a different time zone) of completing a payroll every Friday, Monday, and Tuesday in addition to auditing of new hires, transfers, salary changes, etc. that were received from Human Resources and the processing of twice weekly on-demand checks for adjustments, termination, learning new programs, etc. At Harrah's, these duties where divided among several clerks. The stress of trying to do them all by myself caused me to have severe pain in my shoulder and chest. I was admitted to the hospital for two days in September 2009. It was ruled out that it was my heart. At the beginning of October 2009, I was diagnosed with arthritis and given medication that stopped the pain. However, the more I stressed in trying to meet the deadlines, the pain returned and taking the medication caused me to be drowsy. I resigned my position on October 16, 2009 because I just was not able to meet the deadlines and have not had pain since. I have been seeking employment with companies that process payroll within the city, administrative position, and Property Management positions.

I've been working at my current job in MA for a number of years (5+) and as time has gone on, they've had more and more financial difficulties. For more than a year now, they went from direct deposit to personal checks for paychecks and have had problems paying on time. Lately it has gotten even worse. My paycheck for Oct 16th was late 10 days. The one for the 30th was 14 days late (last fri, when I should have been getting a new paycheck).

Since I was nervous about it, I went to cash it at the bank it was drawn on and it had insufficient funds. My boss called me (since the bank called him) to say I should have cashed it at my own bank instead since the money would have been in there by the time my bank requested the funds. I'd guess it is probably true (despite everything, there's never been any bounced checks) but it still makes me uncomfortable. The check I was supposed to get this last Friday they claim I'll get on Wednesday, but who knows since they frequently say checks will come on a certain day and then they up up pushing it further on again.

I also found out that they've been withholding taxes and 401k money from the paychecks but haven't actually been paying it out to the gov or the 401k funds. That's been going on for a least a couple of months. It also happened for a span of six months or so last year and there was a bunch of hoopla about how it wouldn't happen again and now it has. I don't have a 401k plan myself so not sure if that effects me, though maybe the tax thing does.

Plus there's the fact that a lot of freelancers and vendors haven't been paid, which gives the company a bad reputation. I feel like at this point it is actually hurting my personal reputation to be working here. I'm looking for work but haven't found anything yet. I'd like to try to quit and get unemployment, but I want to try to get a feel for if I can get it. I tried calling unemployment directly but they said they couldn't give any guidelines on what is just cause and I'd just have to quit and apply.

Someone else who quit here about 6 months ago was able to get unemployment but it just makes me nervous that I have to quit before I can have any idea of if I'd qualify..

ivdflr, your situation is extremely complicated. You should definitely talk to an attorney ASAP. Take a look at our article, "Get Help Getting Unemployment" (http://www.thebeehive.org/jobs/unemployment-101/getting-unemployment/get...) for a list of legal resources. You should start by contacting your local Bar Association (there is a link in the article for a list of local Bar Associations) and ask them to put you in contact with an attorney that specializes in employment matters. You can also ask them to put you in contact with a local legal aid organization that would give you advise on this matter for free. If, for some reason, they are unable to point you in the right direction, start contacting the other legal organizations on the list until you find someone who can.

This is actually a question concerning my girlfriend. She was fired last May from her job in South Carolina, she is planning to move to Charlotte, NC with me but has been unsuccessful in finding a job. I mentioned collecting unemployment before but she hasn't done anything about it. My question, is she eligible to for unemployment should she move to Charlotte? I think it would help her out a ton with her car payments and other bills. She's able to work and has been actively searching for jobs since getting fired. If she can qualify that would be great news.
